Welcome to Logan Gold Buyers. These Terms and Conditions (“Terms”) govern your use of our websites and services. By creating an account or purchasing any product or service from us, you agree to these Terms. If you do not agree, please do not use our sites or services.
About Logan Gold Buyers: Logan Gold Buyers, owned by Brisbane Gold Brokers (Gold Brokers Group) ABN 86 162 178 341, with head office at Suite 401/180 Queen St, Brisbane QLD 4000, operates online through multiple domains. Our main website is brisbanegoldbrokers.com.au, and we also operate online stores for each of our physical stores. Content and prices may vary between these sites, but the product range and services offered are identical. References to “Logan Gold Buyers,” “we,” “us,” or “our” in these Terms refer to Logan Gold Buyers and all associated websites. References to “you” or “customer” refer to the user of our websites or services.
We reserve the right to update or modify these Terms at any time. Any changes will be effective once posted on our website. It is your responsibility to review the Terms periodically. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
1. Account Registration and Verification
To purchase products or use certain services, you must register for a Gold Brokers account.
- Eligibility: You must be at least 18 years old and use your real identity to register an account. By opening an account, you confirm that all information you provide is accurate and complete.
- Identity Verification (AML/CTF Compliance): During account creation, we require verification of your identity in accordance with the Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws. You will be asked to provide identification documents (e.g., driver’s license, passport) or complete an electronic identity verification process. Providing false or misleading information is an offence. We may use third-party services to verify your identity; by registering, you consent to this verification process.
- Account Approval: After you submit your registration and verification information, our team will review your account. Accounts require approval by Logan Gold Buyers before you can make any purchases. We may request additional information if needed. You will be notified when your account is approved. We reserve the right to decline an account application at our discretion (for example, if verification cannot be completed or for any concern).
- Account Security: You are responsible for maintaining the confidentiality of your account login details. All activities under your account are your responsibility. Notify us immediately if you suspect any unauthorised use of your account. We are not liable for any loss or damage arising from unauthorised access resulting from your failure to secure your credentials.
- Account Suspension or Termination: We reserve the right to suspend or terminate your account (with or without notice) if you violate these Terms or if we suspect any fraudulent, illegal, or improper activity.
2. Pricing and Orders
Our product prices (especially for precious metals) are dynamic and subject to market fluctuations.
- Live Pricing: All bullion product prices on our website are updated frequently (approximately every 5 minutes) based on live market rates. Prices are shown in Australian Dollars (AUD) and include any applicable taxes unless stated otherwise. We strive to ensure price accuracy at all times.
- Placing an Order: When you add products to your cart and proceed to checkout, the prices of those items are locked for a short period to allow you to complete the purchase. You will have 10 minutes to finalise your order once you begin the checkout process. A countdown or timer may be displayed. If you do not complete the purchase within 10 minutes, your session may expire and your cart will be reset with the latest updated prices. After 10 minutes, you may need to restart the checkout and prices might have changed to reflect current market rates.
- Binding Contract: Once you successfully complete the checkout process and place your order (e.g., by clicking “Place Order” or equivalent), you are making a binding offer to purchase the selected products at the agreed price. If the order is accepted by us, a purchase contract is formed. We will send you an order confirmation email summarising the details. At this point, the price is locked in, and you are obligated to pay for the order. Payment is due within the timeframe specified (see Payment section).
- Order Review and Approval: All orders are subject to review by Logan Gold Buyers. We reserve the right to take up to 3 business days to verify and approve transactions, especially large orders or first-time orders, as part of our fraud prevention and compliance procedures. We may contact you to provide additional verification or information (for example, confirming your payment or identity details) before an order is finalised or dispatched.
- Right to Refuse or Cancel Orders: Logan Gold Buyers reserves the right to refuse, cancel, or limit any order at any stage for any reasonable reason. This includes (but is not limited to) situations where:
- The pricing of a product was displayed incorrectly due to technical errors or rapid market movements.
- The item is out of stock or not available in the quantity ordered.
- We detect potential fraudulent activity or a violation of these Terms.
- Payment is not received within the required timeframe or payment fails to clear.
- Information Accuracy: We make every effort to ensure that product descriptions, pricing, and other content on our website are correct. However, mistakes can occur. We reserve the right to correct any errors, inaccuracies, or omissions (including after an order has been placed). If a correction affects your pending order (e.g., a pricing error), we will contact you and you may have the option to reconfirm the order with the corrected information or cancel it for a full refund.
3. Payment Terms
By placing an order, you agree to pay the total amount due as indicated at checkout, including the product price, any applicable taxes, fees, shipping, and insurance (if selected).
- Accepted Payment Methods: We accept payment via direct bank transfer (EFT), credit/debit card and pay-in-store for online purchases. Credit/debit card payments are processed securely through Stripe on our behalf.
- Payment Timeline: If you choose to pay by bank transfer, you must initiate the transfer within 24 hours of placing your order. Our bank account details will be provided at checkout or in your order confirmation. It is important to use your order number as the payment reference. For credit/debit card payments, the charge will be processed immediately upon order placement. For pay-in-store, payment will be required at your chosen store location at time of collection.
- Surcharges: Payments by credit or debit card will incur a surcharge of 1.7% of the transaction value plus a fixed $0.30 (AUD) fee. This surcharge is to cover the merchant fees charged by our payment processor (Stripe). The surcharge amount will be added to your total at checkout and clearly indicated before you confirm payment.
- Cleared Funds: Your order will only be finalised (and eligible for shipping or pickup) once we have received cleared payment in full. For bank transfers, clearance can take 1-2 business days (depending on your bank). We will notify you if we have not received payment within the expected time. If payment is not received within 24 hours (or a reasonable timeframe at our discretion), we may cancel your order (see “Pricing and Orders – Right to Cancel Orders” above) and release the reserved items/prices.
- No Third-Party Payments: We do not accept payments from third parties or from accounts that are not in the same name as the Logan Gold Buyers account/order holder. All payments must originate from the bank account or card of the person or entity purchasing (the account name should match our customer records). If we identify a payment from a different party, we reserve the right to reject or refund such payment and cancel the associated order, unless prior arrangements have been agreed upon. This policy is for fraud prevention and compliance purposes.
- Ownership and Risk: Products remain the property of Logan Gold Buyers until full payment is received and cleared. We reserve the right to withhold delivery or pickup of any product until payment is fully confirmed. If payment is not completed or is reversed for any reason, we have the right to reclaim the products or seek payment.
4. Shipping, Collection, and Storage
In-Store Collection (Pickup)
Customers may elect to collect their order in person from our retail network rather than having it shipped. Collection is subject to our operational security protocols and may involve additional processing steps prior to release.
- If you select Local Pickup at checkout, you will receive a formal Ready for Pickup notification once your order has cleared internal verification. Please do not attend the store until you have received this notification, as unscheduled arrivals cannot be accommodated for security and compliance reasons.
- Orders can only be released to the account holder or a duly authorised representative formally nominated in advance. At the time of collection, government-issued photo identification (driver’s licence, passport, or equivalent) and a copy of the order confirmation must be presented. Additional verification measures may be applied at our discretion to ensure goods are released only to the lawful owner.
- There is no fee for in-store collection. However, once notification has been sent, orders should be collected within a reasonable timeframe (generally within 14 days). Orders not collected within this timeframe may be transferred into secure storage and subject to storage fees or, in extreme cases, cancelled.
- Due to inventory allocation requirements, order preparation for collection can take several days and in periods of elevated demand may extend to 2–6 weeks.
Shipping (Delivery)
We provide secure shipping services for customers across Australia (no international destinations). Shipping methods are determined by order value, destination, and prevailing logistics capacity.
- Carriers and Methods: Orders below certain thresholds may be shipped using Australia Post (registered or express) or equivalent courier services. High-value consignments may require armoured logistics partners or specialised bullion carriers. Delivery channels are chosen at our discretion to ensure optimal security for the specific order.
- Processing and Dispatch Timeframes: We aim to dispatch most orders within 1–5 business days of payment clearance if items are immediately available. However, due to factors such as vault transfers, allocation scheduling, or high-volume trading periods, preparation may extend to 2–4 weeks. These timeframes are indicative and not guaranteed.
- Tracking and Proof of Delivery: All shipments include tracking and require a signature upon delivery. Couriers are instructed never to leave bullion parcels unattended. You (or your authorised recipient) must be available to sign, and ID may be requested by the courier at handover.
- Insurance: Insured shipping is strongly recommended. If you decline insurance, you assume the risk for any loss, theft, or damage once the parcel is handed to the carrier. If insured, we will liaise with the insurer to resolve claims; replacements or refunds will only be processed once the insurer confirms settlement.
- Risk Transfer: Risk of loss passes to you when your order is consigned to the carrier, regardless of insurance status. Title (legal ownership) transfers only upon full payment in cleared funds. Customers are encouraged to inspect packages upon delivery and notify us immediately of any tampering or discrepancies.
- Delivery Exceptions: In the event of delays, disputed deliveries, or tracking irregularities, customers agree to cooperate with carrier investigations (including affidavits of non-receipt, if required). Delivery timeframes are estimates only and not contractual guarantees.
Secure Storage Services
As an alternative to physical delivery, Logan Gold Buyers provides institutional-grade vaulting services. Metals are held under rigorous security, with full insurance coverage and independent audit processes.
- Storage Allocation: At checkout, certain products may be directed into Allocated Storage or Secure Storage. Orders undergo inventory verification, vault transfer (where required), and quality control before formal allocation is confirmed. This preparation may take several days and during high-demand periods may extend to 2–4 weeks.
- Fees and Charges: Storage fees apply and are charged annually based on the quantity and type of metal held. Failure to pay storage fees when due may result in penalties, suspension of account access, or liquidation of stored assets to recover outstanding charges.
- Access and Withdrawals: Customers retain ownership of stored assets. Withdrawals (either for delivery or in-store collection) require advance notice (generally 48–72 hours for larger requests) to allow time for vault release protocols. Handling fees may apply.
- Sales of Stored Metals: Customers may sell stored assets back to Logan Gold Buyers via their account portfolio. Settlement is processed via our buyback desk in accordance with prevailing spot prices and published buyback premiums. If the stored metal was added manually via in-store purchase, you will need to go in-store to sell.
- Insurance and Liability: Metals stored with us are insured while in our custody. Our vaults undergo regular reconciliation and third-party audits. In the unlikely event of a loss, liability is limited to the insured replacement value. Customers acknowledge that while institutional safeguards are applied, no system is entirely risk-free.
5. Products and Services
Logan Gold Buyers provides a range of products and investment options in precious metals. By purchasing or using any of these products/services, you agree to the specific terms applicable to them, as outlined below:
- Physical Bullion Products: We sell physical precious metals, including gold, silver, and platinum products (such as coins, minted bars, cast bars, and other bullion items). When you purchase physical bullion, you can choose to take possession via shipping or in-store pickup, or opt for vault storage (as described above). All physical products are sourced from reputable mints and suppliers. We guarantee the authenticity and purity of the bullion we sell. Certificates or assays may be provided for certain products as applicable (e.g., assayer’s certificate for gold bars). It is your responsibility to ensure safe handling and storage of the metals once they are in your possession.
- Allocated Pool Holdings: We offer an investment option known as pool allocated precious metal holdings (sometimes simply called “pool accounts” or “unallocated holdings”). This allows customers to purchase a share of a larger pooled quantity of metal (e.g., gold, silver, or platinum) held by us. When you buy, for example, 10 oz of Pool Gold, we allocate that amount to you from a pool of physical gold that we store and manage.
- Your pool holdings will be added to your online portfolio after your payment is received. You will see the metal type and quantity in your account dashboard.
- Pool holdings are backed by physical metal in our vaults, but you do not have specific numbered bars or coins allocated to you; instead, you own a portion of a bulk holding. We ensure that the total metal in the pool is equal to the total of all customers’ pooled holdings (with audits to verify this).
- You can request to convert your pool holding into physical bullion at any time. This process is sometimes called “barring” or fabrication. For example, if you have 100 oz of silver in a pool and want physical silver, we can arrange to manufacture or provide equivalent bars/coins (in standard denominations) for you. Converting from pool to physical will incur a fabrication fee (to cover the cost of producing individual bars or coins) and may require notice (typically 1-2 business days) depending on the amount. We will inform you of the fee and timing when you make the request, and you can then decide to proceed or not.
- You may also choose to sell your pooled metal back to us at any time. You can do this through your account by placing a sell order for a portion or all of your pool holdings. The price we pay will be based on the prevailing spot price minus any stated buyback fee or discount (we are transparent about our buy/sell spreads). Once we confirm and execute the sale, the AUD value will be credited to you (we’ll arrange payment to your bank account, usually within 1-3 business days of the sale confirmation).
- Pool holdings give you flexibility and avoid the need to handle or store physical metal yourself, but remember that until you convert to physical or sell, you are exposed to market price movements of the underlying metal. There are no ongoing management fees for pool holdings beyond storage costs which are typically minimal, but do check if any storage/admin fee applies for pooled accounts.
- Auction Services: From time to time, Logan Gold Buyers may offer certain products (especially rare or high-demand items) via online auction. When participating in auctions on our site:
- You must have a verified and approved account to place bids.
- By placing a bid, you agree to purchase the item if you are the winning bidder. All bids are final and cannot be retracted. Bidding is a binding commitment to buy if you win.
- If you win an auction (i.e., your bid is the highest at auction close, and it meets any reserve price that may have been set), you will be notified by email or through your account. The winning bid price is the price you must pay for the item. Payment for auction wins is due within 24 hours of the auction ending. Standard payment methods and rules apply (including bank transfer or credit card with surcharge).
- If the auction winner fails to pay within 24 hours or the payment does not clear, we reserve the right to cancel that winning order. In such cases, we may offer the item to the next highest bidder or relist the item in a new auction or sale. Additionally, failing to complete payment on an auction win may result in the suspension of your account or disqualification from future auctions.
- All auction sales are final. There are no refunds or returns on auction items except as required under consumer law (e.g., if an item is counterfeit or not as described, which is highly unlikely as we verify our products).
6. Selling Gold and Precious Metals to Logan Gold Buyers
Logan Gold Buyers not only sells bullion but also buys gold and other precious metals from customers. If you have gold, silver, platinum in various forms (bullion coins/bars, scrap jewelry, etc.) that you wish to sell, you can do so through the following methods:
- In-Store Selling (Face-to-Face): You can bring your precious metals to our office/store for an in-person evaluation and sale. No appointment is strictly necessary (during business hours), but we recommend contacting us ahead of time for large sales or for bulky items. When you arrive, our staff will inspect and test the items you wish to sell. We use industry-standard methods (XRF electronic testers and certified scales) to determine purity (karat for gold) and weight. Based on the time’s prevailing market prices and the purity of your items, we will quote you a buyback price. (We publish live or regularly updated buyback rates on our website for common items and gold purity levels as a reference.) If you accept our offer, we will proceed with the transaction. You will need to provide identification (such as a driver’s license or passport) as required by law for second-hand dealers and AML compliance. Payment to you will be made via instant bank transfer (preferred for speed and security). In most cases, funds are transferred immediately upon completion of the transaction. Cash payments may be available for smaller transactions; however, this is subject to cash being available on-site at the time of the sale. If you require cash payment, we recommend providing at least 24 hours’ notice so we can arrange funds from our bank where possible. We do not guarantee cash availability without prior notice. We do not issue payment to third parties – the payment must go to the person selling the items.
- Postal Selling (Mail-in Service): If you cannot visit us in person, you have the option to sell your precious metals via a mail-in process:
- Package your items securely. We strongly recommend using a padded envelope or box, and sealing any coins or small pieces in bags. Include any documentation we requested (like a printout of the email confirmation or reference number, and a copy of your ID for verification). Insure the parcel for the estimated value of its contents – this protects you in case the package is lost or damaged in transit. We cannot be responsible for parcels that are lost or damaged before reaching us, so insurance is very important.
- Ship the package to the address we provide (which will be our Brisbane office or a designated secure PO box). Use a trackable shipping method (like Australia Post Express Post with Signature, or a courier service).
- Once we receive your package, we will notify you. Our evaluators will then open the package under video surveillance (for security and transparency), test and weigh the contents, and assess the value just as we would in person. We will contact you with our official offer for your items, based on the confirmed weight and purity and the current market price. Note: If the items received do not match what was described (e.g., lower purity or different quantity), we will adjust the offer accordingly and explain the differences.
- If you accept the offer, we will arrange payment to you via bank transfer (usually within 1-2 business days). If you decline the offer or if we cannot come to an agreement, we will return the items to you. Return shipping will be at your cost, and we can deduct the return postage from your insured shipment if needed. We will insure the return shipment for the value you stated or our evaluated value, whichever is lower, unless you request otherwise.
Note: It is recommended you have a verified Gold Broker account before using the mail-in selling option but not required.
For both in-store and postal sales, the prices we pay are based on the live market spot prices minus a margin that covers our refining and handling costs. Our published rates for common gold purities (24k, 22k, 18k, etc.) and silver are updated regularly on our website. These rates are a guide; final pricing may vary depending on the specific item or quantity (for example, we might pay a premium for certain high-demand bullion, or slightly less for very small quantities or items that require extensive refining). We commit to transparent and fair pricing for all buybacks.
Please note that all transactions to purchase metals from customers are subject to our verification and security procedures. We may refuse to buy any items if we suspect they are stolen or counterfeit, or if required documentation (like ID) is not provided. We may also report certain transactions to government authorities as required by law (such as AUSTRAC for large cash transactions or suspicious matters).
7. Returns and Refunds Policy
Due to the nature of precious metals products and market volatility, all sales are final. Logan Gold Buyers will not offer returns, exchanges, or refunds on bullion or currency products once a transaction is completed, except in very specific circumstances outlined below or where required by law.
- No Change of Mind: We do not accept returns or provide refunds if you simply change your mind about a purchase. Please be sure of your decision before finalising your order.
- Market Price Fluctuations: We cannot offer refunds or credits based on subsequent changes in the market price of precious metals. Once your price is locked in at the time of purchase, you assume the risk (and benefit) of market movements. For example, if the price of gold drops or rises after your purchase, we will not adjust the order price or offer a refund; you either enjoy the benefit or bear the loss of that market change.
- Order Cancellation: Once an order is placed and confirmed on our website (and you have a confirmed order number), it cannot be canceled by you without our consent. Likewise, we do not allow refunds simply because you wish to cancel the order. As mentioned in the “Pricing and Orders” section, if you fail to pay for an order within the stipulated time, we may cancel it (and potentially charge a fee or claim losses if appropriate). But if you have paid and the order is being processed, you are committed to the purchase. Please double-check your cart and details before confirming an order.
- Quality and Authenticity: All products we sell are genuine and as described. In the extremely unlikely event that you receive a product that is not what you ordered, is significantly different from its description, or is proven to be counterfeit or of incorrect purity, we will correct the issue. This may involve an exchange for the correct item or a full refund of the purchase price, at our discretion. We will cover any return shipping costs in such cases. You must notify us within 7 days of receiving such a product and provide details and evidence of the issue (e.g., photos, assay results). We may require the item to be sent back to us for inspection (we will provide instructions and cover postage). If the item is confirmed to be incorrect or faulty, we will provide the remedy as outlined. This is in line with your rights under Australian Consumer Law for receiving products that are not as described or not of acceptable quality.
- Shipping Loss or Damage: If your order was shipped with insurance and it gets lost or damaged in transit, we will work with you to resolve the problem, which may include sending a replacement (if available) or issuing a refund, once the loss is confirmed by the carrier/insurer. It’s important that you report any damaged or missing packages to us immediately and follow our instructions as well as any guidelines from the shipping carrier (for example, you may need to sign an affidavit or provide photos of damage). If you did not choose shipping insurance, we will assist you in filing a trace with the carrier, but ultimately we are not liable for uninsured losses in transit (as per the Shipping section and our insurance recommendation). Any compensation in such cases would be at our discretion and not guaranteed.
- Returns of Physical Products: Aside from issues of wrong or defective products, we do not accept returns on bullion or coins once they have been delivered/picked up, due to the risk of tampering and the fluctuating market value. If you believe a delivered product is defective or damaged (for example, if a bullion bar is visibly damaged in a way that affects its value, excluding minor minting imperfections), contact us to discuss a solution. We may, at our discretion, offer to replace the item with an identical one if available, or facilitate a buyback at the current market price, depending on the situation. These cases will be handled individually.
Procedure for Issues: If you encounter any issue with an order (such as missing items, wrong items, or quality concerns), please contact our customer service as soon as possible (and within 7 days of receiving the order). Provide your order number and a clear description of the problem (with photos if applicable). We will promptly investigate and advise you on the next steps. Your satisfaction is important to us, and we will work in good faith to resolve any legitimate problems.
Australian Consumer Law: Nothing in these Terms is intended to exclude or limit your rights under the Australian Consumer Law (ACL). Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. The policies we have stated above are in addition to your rights under law.
Please note that any approved refunds will be processed using the same payment method you used for the original purchase (e.g., refund to the same bank account or card). Refunds may take several business days to appear, depending on banking processes.
8. Additional Terms and General Provisions
- Privacy: Your privacy is important to us. We collect, use, and store personal information in accordance with our Privacy Policy. Our Privacy Policy (available on our website) details how we handle your personal data, how you can access or correct it, and how we address complaints. By using our services or creating an account, you consent to the collection and use of your personal information as described in that policy. (Note: This Terms and Conditions document does not include the full privacy policy.)
- Communications & Notifications: By registering an account or making a transaction, you agree that we may contact you via email, phone, or SMS to provide you with important notices or confirmations related to your account and orders (such as OTP verifications, order status updates, pickup notifications, etc.). We may also send promotional communications (e.g., newsletters, special offers) if you have opted in to receive them; you can unsubscribe from marketing emails at any time. We utilise SMS messaging for certain alerts (for example, price alerts, order confirmations, or security verifications). Standard message and data rates may apply for any SMS we send or you receive. If you wish to opt out of non-essential SMS notifications, you may do so through your account settings or by contacting us, but note that you cannot opt out of transactional messages necessary for service (like a login verification code).
- Limitation of Liability: To the maximum extent permitted by law, Logan Gold Buyers (including our directors, employees, and agents) will not be liable for any indirect, special, incidental, or consequential losses or damages arising out of or in connection with your use of our website or services, any transaction or failure to transact, or any act or omission by us. In any event, our total liability to you for any claim (whether in contract, tort, or otherwise) will not exceed the amount paid by you for the product or service in question. This clause does not limit your rights under the Australian Consumer Law and is subject to any non-excludable provisions of that law.
- Indemnity: You agree to indemnify and hold harmless Logan Gold Buyers and its officers and staff from any claim, demand, loss, or damage (including legal fees) arising out of your breach of these Terms, your violation of any law or rights of a third party, or your misuse of our website and services.
- No Financial Advice: Any information provided by Logan Gold Buyers (whether on our website, through emails, or verbally by our staff) about precious metals prices, market trends, or the economic outlook is general information only. We do not provide personal financial advice. You should consider your own financial situation and objectives and seek professional advice if necessary before making investment decisions. Logan Gold Buyers is not responsible for any decisions you make to buy or sell based on information we provide. You are responsible for your own investment outcomes.
- Intellectual Property: All content on our websites (including text, images, logos, graphics, and software) is the property of Logan Gold Buyers or our content suppliers and is protected by intellectual property laws. You may not reproduce, republish, or distribute any content from our site without our prior written consent, except for personal use or as permitted by law.
- Third-Party Links: Our websites may contain links to third-party websites or resources for your convenience (for example, links to articles, charts, or partner services). We are not responsible for the content, products, or services on those third-party sites, and accessing them is at your own risk. Those sites have their own terms and privacy policies which we encourage you to read.
- Governing Law and Jurisdiction: These Terms and any disputes arising under them are governed by the laws of the State of Queensland, Australia. You agree that any legal action or proceeding regarding these Terms (or your use of our services) will be brought in the courts of Queensland. By using our services, you consent to the jurisdiction of the courts in Queensland, and waive any objection to such jurisdiction or venue on grounds of convenience or otherwise.
- Changes to Terms & Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from the Terms and will not affect the validity of the remaining provisions, which will continue in full force and effect. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
